CENTRAL BUREAU OF INVESTIGATION (CBI) – It’s COMPOSITION, Departments and FUNCTIONS

The Central Bureau of Investigation (CBI) is the foremost investigating police agency of the country. Along with being the prime agency of the Central Government, the CBI is also responsible for an extensive variety of criminal and national security matters. 

It functions under the superintendence of the Ministry of Personnel, the Deptt. of Personnel, Pension & Public Grievances, Government of India - which comes under the prime minister’s office.

The CBI was established on April 1, 1963, and extracts its power from the Special Police Force (SPE). Later on, after the reformer change it was brought under the Home Ministry of Government of India.

Organisation of CBI

Currently, the CBI has the following divisions which are working under the union government:

  1. Anti-corruption Division

  2. Directorate of Prosecution

  3. Policy and International Police Cooperation Division

  4. Special Crimes Division

  5. Administration Division

  6. Central Forensic Science Laboratory

  7. Policy and International Police Cooperation Division

Composition of CBI 

The CBI Director is the head of the agency, who is assisted by a Special Director. Further, it comprises the deputy inspectors, joint directors, superintendents of police and various other ranks of police force.

So, overall it comprises about 125 forensic scientists, 5000 staff members, and 250 law officers.

How is the CBI Director is Appointed?

Earlier, the CBI Director was appointed on the basis of the DSPE Act, 1946. But in 2003, DSPE Act was reframed on the Supreme Court’s recommendation in the Vineet Narain case.  Later In 2014, the Lokpal Act provided a committee for appointment of CBI Director. It is headed by the Prime Minister of India. 

How can the CBI investigate any offence?

CBI can investigate into cases in any of the following ways:

  1. Offence Categories– If the offence in which the investigation is sought falls in the purview of any of the categories which it is authorised to investigate then the Central Govt, can order it to launch an investigation into that offence.

  1. On Central Government’s order In some cases, if the Central Government holds an opinion that it should be investigated by the CBI, then it can direct the CBI to take the charge of that particular case/offence. Although, the CBI can’t launch the investigation without getting a go ahead from the concerned state government.

  1. On Supreme Court/ High Court’s orders The Supreme Court and the High Court have the authority to order a CBI investigation into a crime alleged to have been committed in a state even without the state’s consent. 

  1. On recommendation of State Government Any of the state governments can also order a CBI investigation into an offence, if it holds an opinion that the machinery of the state police is not sufficiently able to deal with the investigations into that case.

Conclusion Over the years, the biggest investigative agency of India has built up a metaphor for expertise and integrity. The services of the CBI officers are sought for all important investigations in the country. It’s not only an agency but a sign of truth and supremacy which is held in high esteem by the Supreme Court, the High Courts, the Parliament and the public.
